Stormwater in Ohio

The Ohio Environmental Protection Agency, (OEPA) is responsible for administering the state’s stormwater management program.

State stormwater requirements are mirrored after the federal NPDES program, requiring that stormwater be treated to the maximum extent practicable (MEP).

At the state level, Ohio’s NPDES program requires all construction sites disturbing more than one-acre, many industrial sites, and all designated Municipal Separate Storm Sewer Systems (MS4’s) to obtain permit coverage.

Most sites will be able to obtain coverage under the state general permit, but water quality parameters will be established when the risk of contamination is present on a site-by-site basis.

Stormwater in Pennsylvania

The Pennsylvania Department of Environmental Protection (DEP) is responsible for administering the state’s stormwater management program.

Pennsylvania’s stormwater program is closely modeled after the federal NPDES program, which requires stormwater, is treated to the maximum extent practicable.

Pennsylvania’s NPDES stormwater program establishes permitting requirements for construction sites disturbing more than one acre, industrial sites, and Municipal Separate Storm Sewer Systems (MS4s). All MS4s should currently be permitted, or in the permit process. Each permitted MS4 will be responsible for establishing a Stormwater Management Program (SWMP).

Currently, numeric treatment requirements specific to stormwater have not been established at the state level, but stormwater is often regulated at the local and watershed level in Pennsylvania. It should also be noted that Pennsylvania is currently drafting a comprehensive stormwater management manual that will likely include stringent state level stormwater treatment requirements. Once in place, all communities will be required to meet the new regulations, but may opt to impose requirements, which exceed the state minimum.
